VICTIM/s : 1. Rev. Jemias Tinambacan, 49 years old, a resident pastor of UCCP Calaran, Calamba, Misamis Occidental; an Active member of Kapatirang Simbahan para sa Bayan (KASIMBAYAN); an active member of
Promotion of Church People’s Response-Western Mindanao (PCPR); an active member of Gloria Step Down Movement-Misamis Occidental; and Provincial
Chairman of Bayan Muna-Misamis Occidental; Chairman of the Board of Center for Relief and Development (CENRED); Executive Director of Mission for Indigenous and self-reliance People’s Assistance, Incorporated (MISPA, Inc.)

2. Rev. Marilou Tinambacan, 50 Years Old, former Conference Minister of District Conference of Northern Mindanao (1999-2002); an active member of Kapatirang Simbahan para sa Bayan (KASIMBAYAN); an active member of Promotion of Church People’s Response- Negros  Oriental (PCPR);

DATE/TIME OF INCEDENT : May 9, 2006 5:30 p.m.
PLACE OF INCIDENT : Along national highway in Brgy.
Mobod, Oroquieta City

PERPETRATOR/s : Mamay Guimalan being identified as Military intelligence and three (3) other unidentified assailants riding two (2-black & blue) DT Yamaha-Type Motorcycles

Circumstances: On May 9, 2006 when Rev. Marilou Tinambacan, who was driving their KIA
Besta Van along with his wife, Rev. Marilou Tianambacan while on their way to Oroquieta City from Lopez Jaena, Misamis Occidental when four-ridden (two (2) DT Yamaha-type motor cycle) assailants, one being identified as Mamay Guimalan suddenly shot to death Rev. Jemias Tinambacan along the national highway in Brgy. Mobod, Oroquieta City at around 5:30 pm.

The victim’s van crashed into a Gemelina tree due to gunshot wound that caused him to lose control while driving. The suspects rapidly proceeded towards the victims’ location while saying: “BUHI PA ANG BAYE” (the woman is still alive) upon shooting thrice heading towards the slain pastor’s wife, Rev. Marilou Tinambacan.

Rev. Marilou Tinambacan was able to identify one of the four assailants as Mamay Guimalan, who came closer at the van’s door while saying that she
is alive. Fortunately, they weren’t able to kill her because she was able to hide herself to where she was seated at the front beside her husband.
Rev. Jemias Tinambacan and Rev. Marilou inambacan were immediately rushed to Misamis Occidental Provincial Hospital in Oroquieta City. But Rev.
Jemias Tinambacan failed to survive and finally was transported to Gamalinda Funeral Homes while his wife remain confined at the hospital due to minor bruises and a wound in her head. The slain pastor suffered gunshot
wound at his head that led to his death. ###
 
RECOMMENDED ACTION:
 
Send letters, emails or fax messages calling for:
 
1.        The immediate formation of an independent fact-finding and investigation team composed of representatives from human rights groups, the Church, local government, and the Commission on Human Rights that will look into the summary execution of The Rev. Jemias Tinambacan and Rev. Malou Tinambacan's Frustrated Murder
2.        The arrest and prosecution of the perpetrators of the crime/s of frustrated summary execution and harassment.
3.        The immediate and proper indemnification of the victim and family; and
4.        The Philippine Government to be reminded that it is a signatory to  the Universal Declaration of Human Rights and that it is also a party to all the major Human Rights instruments, thus it is bound to observe all of its provisions.
